These Terms of Service govern your use of Deconfound, which is owned and operated by Homestead Labs, Co. By accessing or using Deconfound, you agree to these Terms.
The Service
Deconfound helps Shopify and ecommerce brands generate ad creative, product imagery, creative directions, and related assets using automation and artificial intelligence. We may change, suspend, or discontinue parts of the service at any time.
Accounts
You are responsible for your account, credentials, and all activity under your account. You agree to provide accurate information and to keep your account secure. You must notify us promptly if you believe your account has been compromised.
Your Content
You retain ownership of the product information, images, store data, brand materials, prompts, and other content you submit or connect to Deconfound. You grant Homestead Labs, Co. a limited license to host, process, reproduce, modify, and display your content as needed to provide, secure, support, and improve the service.
You represent that you have the rights needed to submit or connect your content and that your content does not violate law, infringe intellectual property rights, or violate third-party platform terms.
Generated Outputs
As between you and Homestead Labs, Co., you may use the creative outputs generated for your account for your business and marketing purposes, subject to these Terms, applicable law, and any third-party rights or platform rules. AI-generated outputs may be imperfect, inaccurate, similar to other outputs, or unsuitable for a specific advertising platform. You are responsible for reviewing outputs before publication.
Acceptable Use
You may not use Deconfound to create, upload, or distribute unlawful, harmful, deceptive, infringing, abusive, or exploitative content. You may not attempt to reverse engineer, scrape, overload, interfere with, or bypass security or usage limits of the service.
Shopify and Third-Party Services
Deconfound may connect with Shopify and other third-party services. Your use of those services is governed by their terms and policies. We are not responsible for third-party services, products, data, or platform decisions.
Fees and Payment
Some features may require payment. You agree to pay applicable fees and authorize us or our payment processor to charge your selected payment method. Unless stated otherwise at purchase, fees are non-refundable except where required by law.
Intellectual Property
Deconfound, including its software, workflows, prompts, designs, branding, and documentation, is owned by Homestead Labs, Co. and its licensors. Except for the rights expressly granted in these Terms, no rights are transferred to you.
Feedback
If you give us feedback or suggestions, you grant us permission to use them without restriction or compensation.
Termination
You may stop using Deconfound at any time. We may suspend or terminate access if you violate these Terms, create risk for us or others, fail to pay fees, or if continued service is no longer commercially or legally practical.
Disclaimers
Deconfound is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Homestead Labs, Co. disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Limitation of Liability
To the fullest extent permitted by law, Homestead Labs, Co. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. Our total liability for any claim will not exceed the amount you paid to Deconfound in the three months before the claim, or $100 if you have not paid us.
Indemnity
You agree to defend, indemnify, and hold harmless Homestead Labs, Co. from claims, damages, liabilities, and expenses arising from your content, your use of Deconfound, your violation of these Terms, or your violation of law or third-party rights.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Courts located in New York County, New York will have exclusive jurisdiction, unless applicable law requires otherwise.
Changes
We may update these Terms from time to time. If we make material changes, we will update the effective date and provide additional notice when appropriate. Continued use of Deconfound after changes become effective means you accept the updated Terms.
